Terms and Conditions

Please read very carefully the following Terms & Conditions:

Expedition Tours, a privately owned company based and registered in Ecuador, founded in 2002, is the “Agent” specialized in solution oriented travel arrangements on behalf of the “Client”. The Agent is responsible for organizing (when applicable) the flight, accommodation and other parts of the service offering. “Client” is the person or organization who buys or agrees to buy the services and or travel arrangements or any person on whose behalf you agree to purchase the services and who is listed on the confirmation invoice.

Expedition Tours reserves the right to change any tour or excursion when it deems it necessary for providing better service to its customers and offers the best available alternative.

There is no guarantee that all of the sites, such as museums, monuments, convents among others will be available for visiting and may be closed, due to but not limited to religious dates National celebrations or renovations.

There is no guarantee that specific wildlife, volcano, lake among others shall be observed during a particular tour. All sightseeings and activities are subject to environmental, weather, operational conditions and passenger´s physical condition.

Any independent arrangements that the passenger may participate locally that are not included in the program contracted with Expedition Tours but are rather provided by an independent airline, operator, or local supplier, shall be the passenger’s sole responsibility, who is fully liable for all related risks and costs that must be paid directly to the organizer. Expedition Tours does not supervise or control this portion of the program and cannot be held liable for delays and expenses arising from any act or omission of the organizer or any other party connected with it.

It shall be the Client’s responsibility to disclose to the Agent any medical condition or disability of a member of his party which may be relevant. The Agent cannot accept liability for the unsuitability of any service where the Client has failed to communicate any special condition.

Special requests (e.g. ground floor accommodation, seaview, disability access) shall be communicated by the Client in writing to the Agent at the time of making the reservation. The Agent shall use try to fulfil such requests. The granting of such requests is the sole responsibility of the supplier. No liability shall be attached to the Agent for failure to comply with a special request. Such requests do not form part of the provision of services.

Expedition Tours strives to maintain advertised prices, we must reserve the right to change them at any time after publication for any reason (including because our costs may have changed since those prices were calculated). We also have the right to correct errors.

The Client is responsible to ensure that all of the passengers are in possession of all travel documentation i.e. passports, visas, insurance, vaccinations (where relevant) and that are in order. The Agent is not responsible in a case of a passenger being denied transportation or other service as a consequence of the passenger not having the travel documentation in order.

The Client hereby agrees that he has communicated to each passenger who have bought a provision of services arranged by Expedition Tours that they shall abide by all instructions or directions given by a member of the Agent staff or any crew member of a carrier’s craft or vehicle used in connection with the provision of services, and that they understand that such instructions are laid out for the safety of everybody involved. The Client agrees to indemnify the Agent against any loss or injury suffered or incurred by any other person as a consequence of the passenger’s failure to act in accordance with any such direction or instruction.

Expedition Tours’ website information is correct to the best of our knowledge, at the time the website went live. From time to time we update the information. Expedition Tours does not warrant that the website content is accurate, complete or current at any given time, and we shall have no liability whatsoever in respect of any use which you make of our website content.

Expedition Tours has not involvement whatsoever on activities or excursions, which are not run, supervised and or controlled in any way by us. They are provided by third parties and as such we cannot accept any liability on any basis in relation to such activities. We reserve the right to change the terms and conditions at any time including the publishing of a new website. The client has the responsibility to check from time to time these terms for updates to be sure to be aware of the latest version.

Liability Clause

Expedition Tours acts as an agent for the “Client” (Travel Agent) and on the express condition that shall not be held liable for injuries, losses, accidents, delays, damage to person or property or any other irregularity that may take place due to omission or negligence on the part of the service providers (companies or individuals) that are engaged in or responsible for the transportation (including drivers), accommodations and or other tour-related services.

The agent shall not be liable for any failure to perform any obligation previously agreed which is due to an event beyond the control of the agent and or third parties (person or corporation), including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, strikes, earthquake, flood or any other natural or man-made eventuality outside of the agent’s control, such as discrepancies or changes on aircrafts, cruises, hotels, delays, disruption of schedule service accommodation,re-routing, baggage lost by airlines or third party suppliers who handle inland transfers or arrangements.

Expedition Tours is not responsible if there is a disruption or change in the overall itinerary including but not limited to hotel accommodations, transfers, departure and arrival schedules due to a delay or cancelled flights. Any changes resulting from this eventuality should be arranged for and paid directly by the passenger or the “Client” (Travel Agent).

Expedition Tours shall not accept any liability for any accident resulting from the practice of extreme sports such as but not limited to scuba diving, hiking, cycling, horseback riding, rafting, mountain climbing and other adventure activities. The agent shall not be held liable for any loss, injury, accident, delay, death or harm that the passengers might experience.

The client hereby expressly release and discharge Expedition Tours from all claims, demands, injuries, damages, actions or causes of action. The client accepts the general “Terms and Conditions” and acknowledges that has carefully read and understood them and that is responsible for transmitting them to the end user(s) so that they will be aware of them. The client accepts that this is a waiver and release of liability.

The client acknowledges that has to comply with the individual “Terms and Conditions” of major service providers part of the overall package including but not limited to vessels, cruise ships, airlines, charters, etc.…

The client acknowledges that the passenger is responsible for any penalty, fine, losses of money or expenses incurred for any damage to the vessels, transportation, hotel, or any other property caused by any willful or negligent act on the part of the passenger. The client is responsible to communicate to the passenger all the terms and condition of the individual packages and acknowledges that the passenger has selected a trip that is within their abilities, interests, physical condition and that the decision to participate in the tour has been made taking consideration the safety conditions.

Insurance

It is mandatory for all passengers arriving in Ecuador and using any services arranged by the agent and or third party service providers, to obtain the necessary insurance.  Expedition Tours recommends that all travelers arrange this kind of insurance prior to arrival to Ecuador. Such insurance should include coverage for: travelers, property, life insurance, costs incurred due to medical expenses, accidents, sickness among others, any loss due to trip delay, cancellation, interruption, baggage loss or delay. Expedition Tours recommends that the client arranges the corresponding insurance when traveling to any country in Central & South America.

Jurisdiction

In the event of a dispute between the parties as a result of the present agreement, both parties agree to try to resolve it amicably, however if it was not possible, then any dispute shall be governed by Ecuadorian Law and therefore interpreted within the framework of this law in accordance with the jurisdiction of the Arbitration Court of the Chamber of Commerce of Quito (CCQ), pursuant to the regulations of the Ecuadorian Arbitration Law.
